The National Safety Council reports that the mobile devices are involved in 26% of all motor vehicle crashes.

Cell phones are no joke. Just yesterday as I was riding my motorcycle down Pacific Coast Highway, I saw a young girl who literally was looking down at her lap texting pretty much the entire time she was driving. How in the heck is she supposed to be paying attention to traffic, if she is looking down texting while driving. The answer is obvious, she is not paying attention to what she is doing.

Anytime I handle a motor vehicle accident, car accident, motorcycle accident, truck accident, or other type of accident involving a vehicle, and we get into litigation, I subpoena cell phone records for around the time the accident occurred. If it turns out that the defendant was texting, or on the phone at the time of the accident, it helps me to prove liability in a personal injury case.

The fact that the national safety Council reports that 26% of all motor vehicle crashes now involve the use of cell phones, just goes to show how dangerous and distracting these devices are when you’re driving.

If you’re going to use a cell phone while driving, absolutely use a hands-free device. Not only will you save yourself an expensive ticket in most states, with California my home state especially, you may save a life, or yourself significant money. I can assure you that if you injure one of my clients in a car or other motor vehicle accident, I will be looking at your cell phone records to see if you were distracted.

    Texting and driving do not go together. I hope technology is developed so when a person is driving, then phone stops its texting feature.
