Bicyclist Killed by a Hit and Run Driver at the University of California Santa Cruz

Zachary Parke, 25, of Santa Cruz, was found dead on the University of California at Santa Cruz campus on Wednesday after he was killed in a by a hit and run driver.

His body was found near Heller Drive on Empire Grade Road, which is a primary route for students entering and leaving the campus.

He was in the bushes 15 feet in front of his bicycle, and broken glass littered the ground.

California Highway Patrol officers said Zachary Parke was riding a bicycle when he was hit by a car. A driver traveling in a maroon Nissan or Infiniti fled after hitting the bicyclist, CHP officers said.

Another bicyclist found Zachary Parke’s body at 8:05 a.m. on Wednesday and called 911.

Zachary Parke, who is not a UCSC student, was returning home at midnight from the campus after hanging out with friends, his mother April Parke said.

“His friend left at the same time he did. He saw Zachary take off on his bike going down Empire Grade,” April Parke said. Her son never made it home.

Zachary Parke was an avid outdoor rock climber and studied art at Cabrillo College, according to his Facebook page. He went climbing at Sebastian Big Wall in Yosemite with his friends recently.

April Parke described the pain she felt when an official from the coroner’s office knocked on her door Wednesday morning.

“She said she was from the coroner’s office. I said, ‘Is my son OK?'” April Parke said. “She said, ‘No, I’m sorry, he isn’t.'”

The California Highway Patrol needs help finding the hit-and-run driver. Anyone with information on this accident should contact the CHP at 662-0511. The maroon Nissan or Infiniti is missing a side mirror and likely has front-end damage, officers said.

“Somebody was probably drunk, somebody hit him, and it has to be their fault,” April Parke said.

The bicyclist was seasoned in navigating roads on two wheels. He worked as a bike messenger four days a week for Clutch Couriers and pedaled all over the county, April Parke said.

“They weren’t going to let me see him, but I begged them to let me see him one last time,” April Parke said as tears welled up in her eyes.

UCSC students are taking final examinations this week before the spring semester ends.
Campus security did not block off the road while investigators surveyed the scene. Parke’s body was moved into a coroner’s truck before 10 a.m. and few students realized the tragedy that had happened as they drove by.

The search will resume today for a 16-year-old passenger in a car that slid off Highway 70 that was missing after the horrible car accident, sparking a dramatic swift water rescue, the California Highway Patrol said Saturday night.

Two people died in the fury crash that happened just west of the Plumas/Butte County line at about 3:30 p.m., the CHP said.

The car crashed happened when a 2001 Pontiac Firebird that was headed west on highway 70, when it passed a motorhome and slid off the edge of the roadway, the CHP said.

The driver of the Pontiac Firebird a 35-year-old man had a 9-year-old boy and the 16-year-old with him in the car when it crashed. The CHP said all of them were from Oroville, California.

The 9-year-old boy was clinging to rocks in the river after the accident. The child then let go of the rocks and attempted to swim to the older man.

The driver and the child were pulled from the water by search-and-rescue teams.

The young boy and the man were given CPR. The boy was transported to Feather River Hospital, while the man was taken to Oroville Medical Center.

Both were pronounced dead at the hospitals, the CHP said. Their names weren’t available.

The search for the missing 16-year-old, whose name also was not available, continued until about 8:30 p.m.

This accident is a horrible tragedy, and it reminds us to take it easy out there. A pleasure ride can turn fatal in an instant if you speed, or lose concentration.

A 37 Year Old Women Passenger Killed on I-5

California Personal Injury Lawyer Blog NewsA 37-year-old Montebello woman was killed Monday in a one-vehicle crash on southbound Interstate 5 near Los Banos, the California Highway Patrol reported.

The woman was identified by the Merced County coroner’s office as Josephine Rendon.

Rendon was a passenger in a 2004 Ford F-250 pickup that was traveling about 60 mph south of Highway 165.

The truck was being driven by 34-year-old Jose Serna of Los Angeles. Alvaro Velasquez, 35, also was a passenger in the truck.

The right rear tire of the truck had a tread separation, and Serna reacted by turning the truck to the left. He lost control of the truck, which spun counterclockwise and traveled across the southbound lanes. The truck then overturned in the center divider.

The victim was partially ejected and pronounced dead at the scene.

She wasn’t wearing a seat belt, the CHP reported. Velasquez and Serna were unhurt.

DUI wasn’t a factor in the crash, which remains under investigation.

2 People Hit and Killed by a Big Rig Truck in Pomona

Pomona – A man and woman were struck and killed by a big rig yesterday morning while standing outside their cars on the right shoulder of the eastbound Pomona (60) Freeway, according to the California Highway Patrol.

The 3:15 a.m. accident shut down the eastbound Pomona Freeway between the Chino Valley (71) Freeway and Reservoir Street for more than three hours.

Assistant Coroner Chief Ed Winter identified the victims, who were pronounced dead at the scene, as Otis Lee Hall, 20, of Upland, and Sharon Renee Higgins, 20, of Riverside.

CHP Sgt. Charlie Sampson said Higgins, driving a Mustang, pulled over first, and the Lexus was right behind it. The drivers were standing next to the cars when the big rig drifted onto the right shoulder and hit the vehicles and motorists, then overturned, Sampson said.

Alcohol was not a factor in the crash, but the investigation was continuing into why Martin Llamas, 47, of Galt, allowed the truck to drift onto the right shoulder, Sampson said.

Llamas escaped serious injury but was taken to a hospital as a precaution, according to the CHP, which reported that one of the victims was thrown over the side of the freeway onto Garey Avenue.

It took a crane to right the overturned big rig, according to the CHP, which reopened all eastbound lanes shortly before 7 a.m.

My prayers and condolences go out to the family and friends of the victims of this tragic accident.

Both victims who were 20 years old were just starting their lives.

It does appear that both victims’ families will have causes of action against the truck driver for Wrongful Death in a State of California action.

I do not see any excuse why the big rig truck would go onto the shoulder of a freeway and kill two persons standing there. It makes me sick to think that all the truck driver had to do was be a little more careful to prevent this tragedy.

Natomas Car Accident Kills a Young Woman

California Personal Injury Lawyer Blog NewsA young woman was thrown from her car and killed early today, closing down Interstate 80 near Interstate 5 for a few hours in the early morning, California Highway Patrol officials reported.

The incident involved two vehicles driving eastbound on I-80 at about 2 a.m. said Todd Van Lindt, spokesman for the North Sacramento office of the CHP.

Two women in their early 20s were in a green 2001 Mercury SUV when, for unknown reasons, it clipped a blue 1995 Toyota Tercel in a lane ahead of it.

Both cars spun out of control.

The Toyota went through a chain link fence and came to rest on a divider between the I-80 lanes and the I-5 transition to I-80.

The 41-year-old driver and his 38-year-old passenger had no injuries, Van Lindt said.

The SUV hit the I-80 center median and overturned, ejecting both occupants who were not wearing restraints.

The driver was thrown over the median guard rail into westbound lanes where she was hit by other vehicles.

She was pronounced dead at the scene at 2:12 a.m., Van Lindt said.

Her passenger ended up in the median with a broken back and other injuries.

Officials are still investigating the cause of the accident, but believe alcohol may have been a factor as there are reports the women were coming from a party.

This accident is obviously a tragedy for everyone involved.

Two young students hospitalized after being hit by car in Azusa, California

Two 14-year-old students were hit by a car while walking to school Tuesday morning, leaving them hospitalized in critical condition.

The boy, a student at Azusa High School, and the girl, a student at Foothill Middle School, were crossing Baseline Road near Rockvale Avenue about 7:30 a.m. when they were struck by a white Nissan Maxima driven by an Azusa woman.

Azusa police Cpl. Donald Manley said a preliminary investigation indicated the driver was not speeding nor was she under the influence of drugs or alcohol.

Her view of the street may have been obscured by the morning sun, Manley said.

It has not been determined if she had a green light at the time of the accident.

Ashlie Makroglous, 20, lives in a home next to the intersection. She said it looked as though the girl was injured worse than the boy.

Both students were taken to Los Angeles County-USC Medical Center by a Los Angeles County Fire Department helicopter that landed on the field at Azusa High School a short time after the accident.

“They were here within minutes,” Manley said.

Kathleen Miller, spokeswoman for Azusa Unified School District, said counselors are visiting both schools to speak with students who witnessed the accident. She also said a letter explaining the situation will be sent home to parents.

“We’re praying for the best for both their families,” she said.

The students aren’t the first to be struck by a car in the intersection. In September 2008, 11-year-old Martin Solorio was hit and killed by a car while riding his bike home from his first day at Foothill Middle School.

Makroglous said she didn’t understand why no crossing guard has been posted at the intersection – used by many students who live south of the 210 Freeway.

“That’s now three kids,” she said.

Azusa Mayor Joe Rocha said the city and school district “work together as a team” to provide crossing guards – the city pays for them and the district places them where they are needed.

Rocha said he’d like to see more crossing guards used throughout the city, especially in that intersection.

“I know it is a pretty high speed area,” he said. “You see many kids using the pedestrian bridge and it empties right out into Rockvale.”

Fred Vel, 47, lives next to the intersection and said he was saddened by the accident. He hopes something will be done.

“It would be great to have a crossing guard here,” he said. “Anything to help this out.”

An elderly driver was rushed to the hospital after losing control of her car and smashing into a brick wall.

It happened at approximately 11:30 this morning on the 11700 block of Ventura Blvd. just west of Colfax Avenue.

Witnesses say the woman was driving through an alley on the northbound side of the street when she hit a pothole and careened across both lanes of traffic before slamming into the wall.

“She ran the curb and hit the wall,” said one of the responding LAPD officers.

Police, citing privacy concerns, refused to comment further. However, it did not appear the woman’s injuries were life threatening.

Traffic was slowed travelling eastbound on Ventura Boulevard while the woman was carefully loaded into an ambulance.

Now Police State that the Pothole is not to Blame

 Police determined that witness reports of a pothole were not to blame for a crash that injured an elderly driver.

Officer Karen Rayner of the Los Angeles Police Media Relations Department says the driver simply “lost control” of her vehicle before slamming into a brick wall on the 11700 block of Ventura Boulevard.

According to Officer Rayner, the driver, identified as an 82-year-old female, was headed southbound on Colfax Avenue and attempting to make a right hand turn onto Ventura Boulevard. Investigating officers are still unclear as to what caused the woman to lose control.

The driver was rushed to the hospital complaining of injuries. Police say she suffered a broken bone but the injuries are not life threatening.

The accident happened Friday morning at approximately 11:30 a.m. Traffic was slowed heading eastbound on Ventura Boulevard as paramedics loaded the woman into an ambulance and responding officers stopped to take witness statements.

SAN DIEGO – A collision on a storm-soaked stretch of Interstate 805 in Clairemont Mesa killed a 60-year-old motorcyclist Monday and tangled traffic for hours during the morning commute.

The accident occurred amid heavy rainfall shortly before 6 a.m., when a motorist traveling about 80 mph in the far left-hand southbound lane of the freeway encountered slow-moving traffic ahead of him near Balboa Avenue, causing him to lose control of his Lexus SUV, according to the California Highway Patrol.

The vehicle slid to the right, struck a big rig and caromed back to the left across the roadway, crossing directly in the path of a BMW motorcycle, CHP Officer Allen Reyes said.

The two-wheeler struck the driver’s side of the Lexus, ejecting the rider, Paul Palika of Oceanside. He died at the scene.

The driver of the sport utility vehicle was uninjured. It was unclear if he would be cited in connection with the fatal accident, according to Reyes.

The accident forced the closure of the southbound side of the freeway for several hours. All lanes were open again by just before 8:30 a.m., Reyes said.

I send my prayers and condolences to the family and friends of Paul Palika; he died because some idiot decided to speed in the rain.

Regardless of whether the authorities go after the driver of the Lexus, which they should, the family of Paul Palika has one hell of a wrongful death case against the driver of the Lexus.

A huge 40 vehicle pile-up has left one man dead and several others injured, after heavy snowfalls battered the Sierra Nevada region of California.

The busy Interstate 80 was shut for several hours 70 miles north east of Sacramento while emergency services battled to clear the road after a big rig carrying highly explosive liquid Hydrogen jack-knifed.

The tanker blocked both lanes and as it turned onto its side dozens of cars and trucks ploughed into its side.

Auburn resident Douglas Swasey, in his 60s, was killed in the accident.

The truck was not damaged, officials confirmed, but had it done the hydrogen could have exploded causing even more fatalities.

Three feet of snow fell, creating hazardous conditions for drivers on mountain roads.

The crash at 1.30pm on Friday left the I-80 shut for several hours and caused massive tailbacks, with the route not opening until early this morning.

One driver told News 10 he heard the sound of metal hitting metal for five minutes after the first impact.

More than a dozen other people taken to hospitals in Sacramento and Reno with minor or moderate injuries.

Another driver, Ty Bombach who tried to help the injured told the press: ‘We found a gentleman by the liquid hydrogen truck and I checked his vitals but he was already gone.

I was surprised more people weren’t hurt because of the carnage that was there when we got there and what followed.’

Blizzards and snow up to three feet deep will hit the Sierra Nevada region falling as low as 4,000 feet and will continue over the weekend.

The storms will bring flooding rains, snow and strong winds across much of California.

Heavy rain will affect the central coast and valleys to the Southland from late tonight until Monday, which could bring possible flooding and mudslides.

Coastal regions will suffer up to three inches of rain but south and west-facing foothills and mountains could have as much as seven inches of rain.

A woman died Saturday after the motorcycle on which she was a passenger collided with a car on McHenry Avenue in north Modesto, police said.

The 52-year-old Modesto woman suffered critical injuries and was taken to Doctors Medical Center, where she was pronounced dead, said Sgt. Brian Findlen of the Modesto police Traffic Unit.

She was a passenger on a 1995 Harley-Davidson motorcycle. Authorities did not release the woman’s name because her family had not been notified.

The crash occurred shortly after 8 a.m. on McHenry at Meily Way, just north of Union Avenue, near the Wal-Mart shopping center.

A 52-year-old Modesto man was driving the motorcycle on McHenry in the left northbound lane. An 87-year-old woman was driving a white 1997 Toyota Corolla heading west on Meily, apparently attempting to make a left turn onto southbound McHenry.

Car’s driver was uninjured

Findlen said the Toyota pulled into the path of the motorcycle. The motorcycle driver apparently tried to avoid the collision but lost control and struck the car, Findlen said.

The vehicles came to rest in the middle of McHenry. The Toyota driver did not suffer any injuries.

Findlen said the motorcycle driver appeared to have suffered a fractured leg and a back injury. He was taken to Memorial Medical Center. His injuries did not appear to be life-threatening.

Police did not release the names of the drivers Saturday. Findlen said it did not appear that alcohol or drugs were a factor in the crash.

He said police had not determined who was at fault in the crash. Traffic was slowed while officers investigated the crash site for about two hours, but the road was not closed.

Findlen said it appears the motorcycle driver and his passenger were wearing helmets, but police had not determined whether they were wearing them properly.

As the weather gets warmer, Findlen said it’s more likely that motorcyclists will be on the road. That’s why, he said, it’s important for drivers and passengers to properly wear all the necessary safety gear, including a helmet.

It’s just as important for other drivers to keep an eye out for motorcyclists, Findlen said. Many drivers are conditioned to look only for cars, pickups and other vehicles, failing to spot motorcycles on the road.

“Expect the unexpected and drive defensively,” Findlen said.

It appears to me that the 87 year old woman who turned left in front of the motorcycle is at fault in this accident.

Without the other driver’s information, your chances of recovery in the accident are slim to none.

I have had people with great cases, who could not recover because they failed to get the information of the person who hit them.

As a California Personal Injury Lawyer, I give free consultations to injury victims throughout the State of California almost every day.

Inevitably about 5% of the people I talk to have either tried handling their California personal injury matter on their own, or are very reluctant to “get lawyers” involved because of what they heard about lawyers, or are clueless about how the legal system works.

Firstly, most people have no clue that they are entitled to recover the following damages in a typical personal injury matter:

Out of Pocket Expenses: All out of pocket expenses flowing out of the personal injury matter such as: loss of wages, medical cost, prescription cost, cost of travel to and from the doctor, prescriptions, loss of use of vehicle, either the repair cost of a damaged vehicle, or the fair market value of a damaged vehicle when the repair cost exceeds the fair market value, rental car, loss of future wages, future medical expenses, etc.

Non Economic Expenses: Pain & Suffering, Emotional Distress, Loss of Enjoyment of life (loss of enjoyment of life consists of compensation to a person for not being able to do things that they used to do, while they are injured. Such as cleaning, cooking, walking, dancing, going out, etc.)

In a nutshell a typical person has no clue that they are entitled to the things mentioned above, how to value such things even if they know about it, and most importantly, how to get it.

Going further, if an injured person is married, they typically do not know that their spouse also has a cause of action against the person who injured them for loss of consortium. Hell most personal injury lawyers in California do not even go for loss of consortium.

Loss of consortium in a nutshell is damages that a spouse of an injured party are entitled to, for the loss of the things that their spouse used to do with and for them in the marriage, because of their injury. In many cases loss of consortium can amount to a substantial amount of money.

I have just touched the tip of the iceberg with this article. Ultimately, only a fool has themselves for an attorney.

I can assure you that in 99% of cases, a person without an attorney will get less than a person with an attorney in a California Personal Injury case.

Yes you read the headline of this article correctly; I am sick and tired of ambulance chasers who give ethical personal injury attorneys such as me, a bad name.

An ambulance chaser has been defined by an online dictionary as:

“A lawyer or entrepreneur who hurries to the scene of an accident to try to get the business of any injured persons.”

First of all let me tell all of you something right now, lawyers or their representatives are prohibited from soliciting your business at the scene of an accident in the State of California.

Any attorney who engages in such conduct can face disciplinary proceedings.

If someone is coming up to you at the scene of an accident and recommending an attorney to you; chances are they are engaging in prohibited conduct.

You should never select an attorney based upon a solicitation at the scene of an accident, at your doctor’s office, by the tow truck driver, by a body shop, etc.

Always select someone based upon your own research.

My good friend who is an ex NICB agent, and who now runs an investigative corporation, has told me stories of unethical attorneys illegally paying runners, cappers, doctors, tow truck drivers, body shops, to refer cases to them.

He has also told me stories of personal injury attorneys who are in illegal partnerships with non attorneys to get business.

No attorney can fee share or be in a partnership with a non attorney to get your business.

To be frank, I am absolutely shocked to hear such stories. It is beyond my belief that some unethical attorneys are engaging in such behavior. It is to be frank, despicable.

For attorneys such as me who play by the rules, it is outrageous to think of the poor victims of this type of illegal activity.

Going one step further, you may have recently heard about the explosion in San Bruno and the horrible aftermath.

Sure enough, there are some bottom feeder law firms putting out press releases trying to scavenge business from those poor souls in San Bruno.

Historically in the State of California, attorney advertising was prohibited. In the last several decades attorneys have been allowed to advertise. Some have taken it too far.

I am not against attorneys being allowed to advertise, but I am against what I consider to be ambulance chasing in advertising.

The same thing happened after the Chatsworth Metrorail crash, and many other disasters.

As for me, I am no ambulance chaser. I do not need to be because I am good at what I do.

All of my past and present clients know this to be true. To be good at what you do, you need to actually care about your clients, and get them the money that they deserve.

Ask yourself a question; have you ever heard any other personal injury attorney discussing the topic of this article? Heck No. Do you wonder why? It is the dirty little secret that no one wants to talk about.

Well I am talking about it.

7 people are hit in a Crosswalk in Livermore California by Student Driver

Pedestrian AccidentA woman who was among a group of pedestrians struck by a student driver while crossing a street in Livermore on Saturday underwent more surgery Monday to repair two broken legs, a Livermore police collision investigator said.

Both of the woman’s legs were broken in the crash, and she is expected to be in a wheelchair for at least two months, Officer David Boyes said.

Six other pedestrians were hit as well, and one of them also sustained a broken leg. The others suffered more minor injuries, Boyes said.

The crash happened shortly before 8 p.m. at the intersection of Vallecitos and Wetmore roads.

Investigators determined that Livermore resident Farhat Mohammad, 20, had been driving a Honda Civic west on Wetmore Road when she turned left onto Vallecitos Road and struck the seven pedestrians.

The pedestrians, all adults, were in a marked crosswalk when they were hit, police said.

One person was taken by helicopter to John Muir Medical Center and two were transported by ground ambulance to Eden Medical Center.

Everyone but the woman with the two broken legs has been released from the hospital.

Mohammad had a valid drivers permit and was accompanied by a licensed driver at the time of the crash, police said.

Boyes said there was no indication that drugs or alcohol were involved.

As of this afternoon, she had not been charged with any crime, and the case was still under investigation.
